Regulation

Il significato del termine inglese regulation può variare in base al contesto, anche se il traducente italiano è spesso il medesimo: ecco alcuni esempi.

Il termine regulation si riferisce, il più delle volte, alla secondary or subordinate or delegated legislation (legislazione secondaria o subordinata o delegata) ossia alla legislazione materiale secondaria o subordinata, spesso emanata su delega legislativa e denominata in modo più specifico a seconda dell’ente di provenienza. Si potranno così avere, ad esempio, governmental, ministerial o departmental regulations (regolamenti governativi, ministeriali o di altri enti), a seconda dei casi: “implementation is often subject to industry or governmental regulations, both of which may directly impact final design requirements”. In questo contesto regulation, oltre che con “regolamento”, si può tradurre con “normativa” o “disposizione”. Spesso nei testi giuridici compare l’espressione laws and regulations, utilizzata per riferirsi contemporaneamente alla legislazione primaria e secondaria di un Paese, la quale è da tradursi con la locuzione “leggi e normative”.

Il termine regulation in altro contesto può indicare, altresì, le regole interne di cui si dotano determinati soggetti privati, come ad esempio le disposizioni interne delle aziende che concernono salute e sicurezza sui luoghi di lavoro: il traducente da adottare in questo caso è ancora “regolamento”: “these regulations seek to ensure that the ‘workplace’ (any premises or part of premises which are not domestic premises and are made available to any person as a place of work) is safe for the workforce. Under these regulations every employer shall ensure that (…)”.

Nell’ambito della Unione europea il termine regulation indica invece una specifica categoria di atti tipici a contenuto normativo emanati dagli organi dell’Unione stessa, i “regolamenti”. L’articolo 288 del Treaty on the Functioning of the European Union – TFEU (trattato sul funzionamento dell’Unione europea – TFUE) statuisce infatti che “to exercise the Union’s competences, the institutions shall adopt regulations, directives, decisions, recommendations and opinions”, precisando poi per quanto riguarda in particolare il regolamento che quest’ultima tipologia di atto “shall have general application. It shall be binding in its entirety and directly applicable in all Member States”.
