Equity

Il termine equity identifica un corpus normativo tipico degli ordinamenti di common law, nato nell’Inghilterra medioevale, che non ha niente a che vedere con l’equità propria della civil law.

L’equity di common law è fonte del diritto, poiché consiste in un insieme di norme giuridiche, denominate equity rules (norme di equity), parallele e sussidiarie rispetto alle common law rules (norme di common law). Le norme di equity nacquero in seguito all’attività di jus dicěre che il Chancellor (Cancelliere) iniziò ad un certo a svolgere su richiesta di quei sudditi che non riuscivano a trovare ristoro innanzi alle common law courts (corti regie/corti di giustizia/tribunali del re). Il Chancellor giudicava le controversie sottoposte alla propria cognizione secondo coscienza e non sulla base delle norme di common law.

L’equità di civil law è basata invece sull’antica aequitas romana e consiste in un criterio di valutazione, ad esempio nella determinazione del danno (cfr. l’articolo 1226 del codice civile italiano il quale prevede che “[s]e il danno non può essere provato nel suo preciso ammontare, è liquidato dal giudice con valutazione equitativa”) oppure in un criterio di giudizio a cui il giudice in alcuni casi può ricorrere in via residuale, prescindendo dall’applicazione della norma giuridica (cfr. l’articolo 113 del codice di procedura civile italiano, il quale prevede che “[n]el pronunciare sulla causa il giudice deve seguire le norme del diritto, salvo che la legge gli attribuisca il potere di decidere secondo equità” o l’articolo 114 del codice di procedura civile italiano, il quale prevede che “[i]l giudice, sia in primo grado che in appello, decide il merito della causa secondo equità quando esso riguarda diritti disponibili delle parti e queste gliene fanno concorde richiesta”).

Di conseguenza, il termine equity va mantenuto in inglese. Il concetto di equità in inglese è veicolato da altri termini, quali reasonableness o fairness.
