Segue: retained EU law

Lo European Union (Withdrawal) Act 2018 – EUWA del Regno Unito, oltre ad aver introdotto in quell’ordinamento giuridico la nuova categoria di norme denominata retained EU law (diritto UE mantenuto/normativa europea mantenuta) (ce ne siamo già occupati qui in questo blog), ne ha anche disciplinato il relativo status giuridico all’interno della gerarchia delle sources of law (fonti del diritto).

Mentre in precedenza il principio della supremacy of EU law (primato del diritto UE), ancora valido per tutti gli Stati che sono ancora membri dell’Unione europea, conferiva a tutta la EU law (diritto UE/normativa europea) una primazia rispetto alla domestic law or legislation (normativa o legislazione interna), in seguito alla Brexit tale impostazione con riferimento alla retained EU law è venuta meno.

Si tenga presente che lo EUWA mantiene il diritto UE in base a tre diverse disposizioni:

  • l’articolo 2 preserva la EU-derived domestic legislation (legislazione interna derivante dall’Unione europea) e si riferisce essenzialmente alle regulations (normative) o alla primary legislation (legislazione primaria) emanate in attuazione di EU directives (direttive UE);
  • l’articolo 3 preserva la direct EU legislation (legislazione UE di diretta applicazione), consistente essenzialmente nei EU regulations (regolamenti UE);
  • l’articolo 4 preserva qualsivoglia ulteriore diritto, potere, responsabilità, obbligazione, restrizione, rimedio e procedura residuale, che abbia direct effect (effetto diretto) nell’ambito del diritto UE, ferme restando alcune specifiche eccezioni.

Il diritto UE mantenuto in base all’articolo 2 EUWA possiede già uno status giuridico interno, configurandosi quale secondary legislation (legislazione secondaria) oppure, in alcuni casi, primary legislation (legislazione primaria) ossia Acts of Parliament (leggi del Parlamento). Il diritto UE mantenuto in base agli articoli 3 e 4 EUWA non costituisce né primary legislation, né secondary legislation, ma consiste in una new category of domestic law (nuova categoria di norme interne), accompagnata da un corpus di new bespoke rules (nuove disposizioni ad hoc) volte a disciplinare la procedura per una loro eventuale modifica.

La retained EU law è un nuovo istituto di common law che sarà oggetto di specifico approfondimento all’interno della seconda edizione, completamente riveduta e aggiornata, dei manuali di traduzione giuridica dall’inglese all’italiano di L&D traduzioni giuridiche, attualmente in corso di lavorazione.
